RIAA Wins Music Sharing Case
Welcome back!
The jury in the Capitol Records v. Jammie Thomas infringement trial came back in only four hours and awarded $222,000 in damages.
This came in spite of the fact that it just didn't add up. From what I read in the above article, I don't see how they could have found her guilty. If only because there's some holes in what the prosecution was trying to establish. Apparently they managed to avoid addressing the possibility that somebody else was using that username and spoofing the IP address.
Then there's a question of time stamps on files found on her hard drive and whether or not the songs could have been ripped from CD instead of downloading them.
All in all, the case has holes in it and there is more than reasonable doubt. The one thing that this case is going to do is encourage the RIAA to continue it's reign of lawsuit terror.
The one thing that people can do to help put an end to this nonsense is to support DRM Free music downloads and if you share files on P2P networks, take great care to be secure and anonymous.
