The New Jersey Supreme Court has become the first one to recognize that people have a reasonable expectation of privacy when using the internet anonymously. This is a major step along the way to getting legal recognition of people’s right to privacy online. It doesn’t matter what you’re doing whether it’s shopping for new MP3 players or researching some medical condition, you’ve got a right to expect privacy online.
Specifically, law enforcement agencies need to get a warrant before they can legally require an ISP to hand over information about a subscriber.. billing information, contact information, what IP address you have at a given time and so on.
This is an important first step but there is a LONG way to go. The ability to have and maintain privacy on the Internet is there but everybody has to be responsible for achieving and maintaining their own privacy.
