RIAA Appealing Judges Decision To Set Aside $222,000 Verdict

In the case of Capitol v. Thomas, the judge has ruled that his original instructions to the jury, which accepted the RIAA's "making available" theory and the 'offer to distribute' theory, was in error. As a result he set aside the verdict in which the RIAA had won $222,000.

It must be noted that the song files that the suit was about have a value of about $25. All I can say is that I'm glad that most other buisnesses aren't quite so extreme in the way they do things. Otherwise an auto insurance company might end up suing somebody a couple hundred million for a $1,500 junker that got totaled.

Honestly, I think that they're going overboard and have been for a long time now. Besides which, it's long past time for them to realize that they're infinitely better off going after the people who're ripping off copyrights and making a profit doing so.

The average P2P user isn't looking to make money, they just want to hear a song that they might consider buying the album for if they like it and the record companies can pull their heads out long enough to knock off the DRM.

I also note that the judge appears to feel the same way because part of his decision was dedicate part of his decision to address the need for Congress to get some changes made to copyright law so that this kind of excess doesn't happen anymore. The RIAA are, as many of us already know, spending inordinate amounts of time and money going after the wrong people for the wrong reasons
